THE MURDER OF ISHRAT JAHAN

 



 

 

There is a lot of confusion in the minds of  certain individuals about the actual sequence of events in the Ishrat Jahan fake encounter case. This has given a lot of opportunity to members of Sangh Parivar to distort and mislead the public and present the murder of Ishrat Jahan as if it was a genuine encounter. Encounter as the name suggest means killing in self defense when the opponent challenges or open fires on the law enforcement agencies. This never happened as the case reveals

I am giving below a detailed account of the event which has generated a lot of interest in the media and in the minds of the common public.

 

THE CASE

 

1.    15.6.2004    

(A)            Ishrat Jahan and 3 others gunned down by Gujrat Police led by PI(Police Inspector) J.G.Parmar

(B)      FIR NO 8/2004 filed by Crime branch Gujrat Police against the following 4 persons

                     Jishan Johar,Amjadali,Javed & one unknown female terrorist

 2.    08.6.2006

  The I.O in the case Mrs Parixita Gurjar submitted her report concluding that they were terrorist and encounter was genuine. The report was submitted to Special Judge POTA

 3.    07.7.2006

  The POTA judge rejects the findings of the I.O and orders further investigation of the matter.

4.    24.9.2010

  The Gujat High Court in pursuance of various petitions filed before it, orders constitution of  a SIT.

 5.   01.12.2011

 The SIT unanimously concludes that the encounter was fake and submits its report to the Gujrat High Court.  Court orders filing of FIR with the CBI.

 6   15.12.2011

 Shri R.R.Verma head of the SIT files FIR with CBI. It states that since the encounter was fake, benefit of killing in self defense does not accrue to the Gujrat Police officers. They have therefore committed offences under section 302(murder) and various other sections of Arms Act

Accordingly CBI registers the case. Shri R.R.Verma subsequently left the SIT leaving behind the next senior officer Satish Verma to complete the job.

INVESTIGATION REPORT OF CBI IN CHRONOLOGICAL ORDER

              SUBMITTED TO THE GUJRAT HIGH COURT ON 3.7.13

 

1. April 2004

  Jishan Johar abducted from Ahmedabad by Sh Rajinder Kumar ( IB Special Director) and Sh G.L.Singhal IPS Officer. They were assisted by passive agents C1 and C2. According to Sh. Praween Swami ( Noted security analyst ) these were Gujrat based  jihadis trained in Pakistan who were persuaded to change sides.

Jishan Johar was kept in Gota Housing, Ahmedabad.

2. 26.5.2004

 Amjadali abducted from Ahemdabad by DCB and SIB officials

Kept in Arhan Farm house. This place was arranged by JG Parmar PI Crime branch. Amjadali has stated that he had come to commit some terrorist act in Ahmadabad.

3. 12.6.2004

 Javed and Ishrat Jahan abducted from Vasad Poll Booth Anand while travelling in a blue color Indica car Regd No 4786

Kept in Khodiyar farm. This place was arranged by Sh DG Vanzara .The following officers of the Gujrat Police met Javed and Ishrat Jahan while in illegal custody

4. 13.6.2004

Jishan Johar shifted from Gota Housing to Khodiyar Farm

In the evening a plan to eliminate all the four was discussed at DG Vanzara office. Other present were PP Pandey and Sh Rajinder Kumar. The plan was to kill them and then lodge a FIR showing their death in a encounter.

 5. 14.6.2004

 3PM  Sh GL Singhal was called by Sh DG Vanzara at his office. A draft of the FIR which was to be lodged after the killing was there. Sh DH Goswami PI was also present

 11PM Sh DG Vanzara briefed the officers about the operation to be carried out which was to be according to the FIR already prepared

 6. 15.6.2004

 2AM  Gunmen Menat & Kalaswa report to GL Singhal

 4AM  NK Amin proceeds to the scene of the crime i.e Kotarpur Water Works with gunmen

Menat, JG Parmar,KS Desai and driver Rupabhai

Two constables bring Jishan Johar,Javed and Ishrat Jahan to the scene of the crime in a Indica Car. The same indica car in which Javed and Ishrat were travelling when abducted on 12.6.2004.

Car is parked across the road divider and Javed is shifted from backseat to the driver seat.

 GL Singhal reaches scene of the crime along with gunmen Barot,Kalaswa,Chaudhary,Chauhan and Nizammudin.

 BA Patel and Taljabhai brings Amjadali to scene of crime in a white qualis.He was made to stand behind the Indica car. BA Patel drove away and Taljibahi remained behind.

 Immediately afterwards NK Amin,Barot,Parmar,Kalaswa,Chaudhary opened fired killing all 4 of them.

 Kalaswa was further ordered to fire from AK-56 on the official gypsy of NK Amin. This gun was then planted on the body of AmjadAli.

 5AM The mission was complete and message was sent that in continuation of Intelligence  output a encounter took place and 4 suspected terrorist killed.Thereafter the FIR was registered.

 

A INTRODUCTION TO MAIN PERSONS INVOLVED IN THIS OPERATION

 

 

 

1. DG VANZARA    1987 batch IPS officer considered close to Modi. He  was DCP Gujrat Crime Branch. He is a encounter specialist responsible  for encounter killings of Soharubdin and his wife,Ishrat Jahan and 3 others, Samir Khan,Sadiq Jamal and many others. After every killings he used to say that they were out to kill Modi. Arrested in 2007

 

2. PP PANDEY  Senior Gujrat IPS officer( 1982 batch ). He was  the Joint Commisioner of  Police heading  the Gujrat Crime Branch when Ishrat Jahan was killed. Vanzara was working under him. He  is absconing and his whereabouts are unknown.

 

 

3. GL SINGHAL  Senior Gujrat IPS officer.Asstt commissioner of police Gujrat crime branch. He led the team which killed Ishrat Jahan. He is currently on bail.Reportedly he has handed over a tape to the CBI containing conversation with Home Miniser of Gujrat.His only son 17 yrs old has committed suicide.

 

 

4. NK AMIN  DSP Gujrat Police.He is also charged in the fake encounter of Sohrabbudin and burning the body of  his wife Kausarbi( The body was never found) . He was one of the person who fired on Ishrat Jahan to kill her and 3 others.He is under arrest.It is reported that he may turn approver.

 

 

 

5. JG PARMAR  Gujrat Police officer who fired on Ishrat to kill. Currently on bail

 

 

 

 

6. TARUN BAROT  Gujrat Police Officer he also fired on Ishrat to kill.   

 

7. MOHAN KALASWA  Fired 32 rounds from his AK-56 to kill. Later the gun was planted on the dead AmjadAli. Mohan Kalaswa is now dead.

8. RAJINDER KUMAR  1979 batch IPS oficer. Special Director IB.Generated the report that Ishrat and 3 others were terrorist. Supposed to be the main planner to kidnap and kill them. Went to meet Ishrat one day before killing them. Said to be present at the crime location when killing took place.

It is expected that he will be named in the supplementary charge sheet.

 

 

SOME FACTS AND CONCLUSIONS

 1. It would be seen that right from the beginning there was a deliberate delay by the Gujrat Govt to derail the investigation. Ishrat was killed on 15.6.2004. Gujrat Police submitted the report after 2 years on 8.6.2006.When the court rejected the report and ordered a fresh investigation the matter was kept pending for over 4 yrs. It  was only on 24.9.2010 that the Gujrat High Court took the matter in its own hand and ordered a SIT. There was absolutely no response from the Gujrat Govt to investigate the fake encounter inspite of serious allegations of murdering Ishrat. It would also be seen that the allegation by the BJP that Congress was behind this is entirely false. The entire investigation was ordered by the Gujrat High Court and is being monitered by it.

2. Ishrat and others were in police custody and were taken out early morning on 15.6.2004 and killed in cold blood. Under no stress of imagination this can be described as a encounter.

3. I for one would even go further and support the killings of  AmjadAli,Johar and Javed if it comes out to be that they were terrorists. Certain information do point towards that direction but needs further clarifications. But what was the sin of Ishrat? Just because she was travelling with Javed does she becomes a terrorist? She was a student supporting her family after her father's death by taking tuitions and embroidery work. She was working with Javed who she probably thought was into some genuine business. Javed knew the family and after the death of  Ishrat father  decided to help the family by employing her. She was travelling with Javed because he was her employer.There  is not a shred of evidence that she was a terrorist.

 4. BJP quotes that Headley statement to NIA mentions her as a suicide bomber. There is absolutely no mention of Ishrat in the NIA report. The former Union Home Secretary NK Pillai has categorically stated that there is not mention of Ishrat in the NIA report. Obviously this is invented by the BJP to justify her killings. Moreover Headley interrogation was done in 2010 so in 2004 how did the IB came to know that she was a  terrorist.

The other fact which BJP repeats is that Ishrat name is mentioned on the LeT website. The fact is that the LeT has already clarified that she has no connection with them. The Gujrat Police and the IB knew very well that Ishrat was innocent. They could have easily devised their operations in such a way that Ishrat could have been spared. But probably a innocent life has no value for them.

It is interesting to note that GL Singhal whose 17 yrs old son committed suicide told the CBI that divine justice was meted to him since he killed a innocent person.

 5. Another interesting fact comes out in the confessional statement of Bharat Patel a accused cop. He states

 " “On June 9, 2004, I (Patel) was with Singhal at about 10.15pm. Singhal had received a message from DG Vanzara to speak to him on the phone. When Singhal called him, Vanzara had instructed him to meet Rajinder Kumar at his residence.
It further states, “Accordingly, we both had reached there. We were told by JD (Rajinder Kumar) that Javed alias Pranesh Pillai, who was under watch of IB for associations and activities with Amjadali, was coming to Ahmedabad along with a girl.” “JD said that the persons would come in the Indica car, gave the number and colour (of the car) and directed to pick up both persons before they reached Ahmedabad, Singhal thought that the idea of picking up the girl was bad: first, the girl was not needed for operational purposes, and it would also lead to complications.”
The statement goes on: “Therefore, Singhal had opined that we should allow them to reach Ahmedabad and then wait for an opportunity to take the boy (Javed Sheikh) alone. Therefore, Kumar had talked with Vanzara. After an hour, NK Amin had come and I (Patel) and Singhal were relieved by Kumar.”

 In my opinion this was the right approach to spare the innocent girl. Javed could have been abducted unseen by Ishrat so that she would have remained ignorant about his whereabouts. Subsequently she would have been under the impression that Javed was killed in a real encounter. Though this was also unethical  but  if thought to be necessary by Crime Branch because of solid evidence that the 3 were terrorist,could be condoned.

GL Singhal advise also proves that the IB & Gujrat Crime Branch were absolutely certain that Ishrat was innocent.

6. Other fact which points towards the murder is that the FIR was drafted in advance on 14.6.2004 in the office of DG Vanzara. This pre prepared FIR was lodged after the killings were complete on 15.6.2004.

 7.  2 years later on 17.7.2006 Modi while addressing a Maharashra state BJP speaks about Ishrat. He says

“…Ishrat Jahan naam ki ek aatankvaadi ladki, jiska HAMARE Gujarat Police ke saath encounter hua…(wipes his face)…aur use maar giraya.”

He is not least bothered that a 19 yrs old girl is brutally murdered and her family is begging for justice. This is the extent that Modi can go to propagate that Muslims are out to kill him, a Virat Hindu. This is the false propaganda which has helped him win the 3 elections. Communal divide is his speciality not development. See the video.

Here it may also be mentioned that when GL Singhal met DG Vanzara on 14.6.2004 Dy SP DH Goswami was also present. DH Goswami has stated that Vanzara clearly told that Kaali Dari wala(Amit Shah) and Safed Dari wala(Modi) has given the clearance to kill Ishrat and others. Modi has now suddenly become dumb and refuses to speak on this case.

 8.  Let us throw some light on the contention of the BJP that since the operation was a joint operation of IB and Gujrat Police the Centre is involved and therefore the PMO is also involved. I heard on a TV discussion where a BJP representative was shouting that even Sonia Gandhi is involved ! At the time of the incident the chief of IB multi agency centre was Ajit Doval who ,it can be safely said must be advising the PMO. After retirement Ajit Doval has become Director of the BJP think tank Vivekanand International Foundation .He is a regular advisor to the BJP.He vociferously supports the killing of Ishrat. So if any information was conveyed to the PMO it was from a BJP sympathiser.

 9. After the killings it was claimed by the Gujrat Police that a bag containing explosive powder was recovered  from the blue Indica car. It  has now been established by the  forensic lab that the yellow powder was not at all explosive material. It is obvious that after the killing the fake powder was planted to show that the terrorists were travelling with the explosives to kill Modi.

 10. It is amazing that the killing squad did not receive a single scratch in the encounter. If the terrorists were armed( including a AK-56) how was it that they could not fire a single bullet on the Gujrat Police. This proves they were not armed but the guns were later planted on them.

 11.Statment of  9 police personnel's were recorded under section 164 CrPC before a magistrate. They vividly described how the police fired Nazi type on the unarmed persons killing all of them.

 12. It was claimed by the Gujrat Police that the persons in the Indica car were firing on them to prove that it was a encounter. Later on when the investigation was done by the SIT it was discovered that the empty shells found in the car did not match with the guns found on the bodies of the killed persons. It is clear that nobody fired on the police but the guns were planted later on.

 13. It was claimed that 4 persons were travelling in the Indica car. But later on after investigation it was found that 3 person were brought from Khodyar farm where they were being kept and  Amjadali was brought from Arhan farm house by a seperate car to the scene of the crime.

From the above photograph it would be seen that though the floor of the car is fullydrenched in blood there is absolutely no blood on the AK-56 magazines. This could happen only if these magazines were planted after the killings.

 

15. 

From the above picture it would be observed that bullets were fired from the left of car and they emerged from the right of the car.The exit points of the bullets have a downward path. If as claimed by the police they were firing from across the road from depressed ground the exit path would have been upwards. Clearly these bullet holes shows that they were killed from very close quarters and barrels were pointed downwards.

See the the picture below. The body next to Ishrat is of Javed. His body is fully drenched in blood but the body of Ishrat has hardly any blood on it. It was claimed that Javed was on the driver seat and Ishrat was sitting beside him. So how is that Javed received so many bullets and Ishrat hardly any. It therefore looks like Ishrat who was drugged was killed separately. Javed received 14 bullets and Ishrat 4 that too on her neck only.

 

16. Many other facts would come to light when the CBI will file the 2nd charge sheet in the last week of this month. It may be pointed out that the Gujrat High Court has restricted the investigation to finding out only if the  encounter was fake or not. Whether the persons were terrorist or not is outside the scope of the SIT. Whatever it may be, if it is proved that the encounter was fake the culprits would be charged for murder under section 302 of CprC.

 

17. In the end it is my opinion that fake encounters to wipe out dangerous terrorists and gangsters cannot be entirely ruled out in view of the ground realities. There is a serious threat to our society from not only Pakistan but also from certain religious extremists inside the country. We can also not close our eyes to extremely slow moving criminal justice system. Bails are easily obtained and cases remain pending for years. Ultra Liberals on one side want all terrorists to be treated strictly under the judicial system and fanatics nationalist want them all to be shot in fake encounters. Both of these extremes cannot be justified. There has to be a middle path. The IB and Crime Branch should not go for killings under any pressure from political masters or in the pursuit for promotions and goodies from superiors. Terrorist are not born in one day. They have a background history,a record of their movements, record of their calls made on phones and so many other details which should be studied by the security agencies. Only on these basis when the concerned officers are satisfied that these are dangerous men with a mission to kill a decision to eliminate them shoud be taken. In this case Ishrat jahan was absolutely not a terrorist. This could have been easily discovered by visiting her family and knowing her background. Killing a innocent 19 yrs old girl was a heinous crime.

Now certainly extra judicial killings are punishable.Laws are necessary to protect the citizens from crime and are here to stay. One cannot throw out the baby together with the bath water. Therefore any such killings which are necessary to protect the society from heinous criminals should be properly planned and cunningly executed so that they remain outside the limits of law. There are many options. Killing them anonymously or killing them without any witnesses. Killing them through means other than shooting. Giving them option of torture or suicide. And so on.  In this case the Gujrat Police made the mistake of mixing Ishrat with these men. It therefore became necessary to kill her also. The IB and the Gujrat Police became extremely careless as if the judicial system did not exist for them.Even a fake encounter has to be genuine.

 

18. Inspite of whatever has been said above the feeling does remain in some corner of the heart that extra judicial killing is cruel. It is also true that our secret security organisations cannot be given unlimited freedom to decide whom to kill. History is witness that such organistions later on become a Frankenstein monster taking law into their own hands in pursuit of some fascist ideology or dangerous patriotism. They become rogue organisations. Hitler Gestapo can be quoted as an example. A perfect example is the ISI of Pakistan which has become a law unto itself. It has permeated all the Govt institutions and even decides the foreign policy of Pakistan. We cannot allow the IB or CBI to become a ISI. Therefore the time has come to give such encounters/killings the approval of the law of the land. We must appreciate that these agencies are working in difficult circumstances. Generally they are discharging their duties to protect the citizens and the nation from our enemies. So why should they be exposed and hounded like criminals when circumstances demand such killings. The Govt should consider inserting clauses in the CprC or amendment in the constitution to legalise such killings when authorised by the competent authority. At present a superior officers gives verbal instructions to his juniors to execute a encounter which is illegal in law. Instead this authority should be legally given to a committee or to a certain rank in the hierachy. The case should be put before them for their consideration  and they should issue orders for the encounter or killing if they are satisfied. This should be made legally valid. It would be something like President Obama issuing a executive order to execute Osama Bin Laden.

23.7.13  CBI announces a reward of 5lakhs each to anybody giving credible  information about 'Real Identity' of Zeeshan Johar and Amjad Ali Rana. Quite strange that these two were killed without knowing who were they.

 31.7.13 The main conspirator PP Pandey who has been absconing for the past 2 months presented himself before the CBI court in a strecher in connection with his bail application.He has been granted bail upto 06.08.13 by the Gujrat High Court .

Dear Mr. Chetan Bhagat,

 

At the outset I must confess that as a ordinary citizen of this country engaged in daily toil for livelihood, I have missed the luxury of enjoying your books. Neither I had the time nor the money to purchase your books. However I take it that you are a fiction writer. To my mind a writer reflects the realities and problems prevalent in the society in his writings in a truthful manner. When a writer starts aligning itself with the ideology of a political party the solutions offered by him becomes adulterated and  controversial. He becomes a spokesperson of that particular ideology and therefore looked down with suspicion and  mistrust. I am afraid that the issues which you have raised in your letter is entirely political in nature reflecting your closeness to the Sangh Parivar. I will tell you why and also try to expose the many untruthful assumptions you have made.

 1.You are well aware that India is a country of many languages,caste,creed and religion. Each of these components join together to make our great nation. Imagine a car which has many components. Some of these components are sturdy some fragile. Some big and others small. Can the car become worthwhile if its individual components are not fit. The components come first and then the car. Similarly it is India. Each community,region, language etc are components. We have to look at each components and see whether they need any help and support from the state. We have to ensure that they all travel towards prosperity,education and jobs and don't lag behind. As a  member of a minority community  it becomes difficult for me to compete in a surrounding where opportunities are limited. So I do need reservations in jobs,concessions in higher education and special attention from the state. What is wrong with it? India will prosper if its various components prosper.

So you see that your contention that uplifting India comes first is not true. It is the other way round. This is a country where a large chunk of its population are muslims.If they feel that they are neglected,threatened and discriminated the nation can never prosper. Infact no nation in the world has prospered where there are internal strife and disaffection among its communities.

  But you have cunningly tried to reject this truth by resorting to a false sense of patriotism  that India comes first. India will only shine if its minorities and backward communities shine. Not the other way round.

Your  above  argument is also in line with the Sangh Parivar  who are against helping Muslims. So please don't try to take away from us what is our right. The right to a dignified life, which only secular parties can give to us.

2.I was also quite amused to see your sarcastic comment  on the issue of  Muslim cap. As a writer I thought you possessed a sensitive mind. A mind of a writer who is aware of human emotions and takes care not to hurt  anybody. But then I forget that you are a crude representive of  a hate ideologue. It is not good of you to make fun of a incidence which had hurt the feelings of millions of Indian Muslims . It was Modi the darling of the Sangh Parivar who disrespectfully refused to wear the Muslim cap which  was offered to him with such love and respect. A million words cannot describe the contempt the Sangh Parivar holds for the Muslims than this one action. At the same function Modi proudly allowed the Sants and Sadhus to apply tika on his forehead and to adorn  saffron shawls on his shoulders.

Dignity and respect comes first for us. We are a proud community and would never surrender to humiliation and indignity. Mr Bhagat if you think that development and progress of our community is going to come from the Sangh Parivar, than sorry you are entirely wrong.

However your sarcastic comments again reveals your proximity to the Sangh Pariwar.

 3.Now to the point of Muslim achievers and your comment on cap wearing politicians. Obviously you refer to non BJP and secular parties. We are proud of these achievers .We are modern in outlook ,educated and not bigoted. We therefore expect that India is ruled by such a enlightened political party and not by bigots. The Babri Masjid was demolished by the Sangh Parivar and celebrations were made. In Gujrat 2000 people were massacred just because they were muslims.Do you really think we have forgotten these communal incidents. The Chief Minister Mr.Modi as head of the state not even thought it necessary to offer a apology. The scheme for scholarships to Muslims have been effectively barred by the BJP. The BJP even refused to build up the various Muslim properties destroyed during the riots. In Madhya Pradesh the BJP introduced Surya Namaskar in schools instead of a better educational curriculum. Now Murli Manohar Joshi is asking for FDI in astrology ! If you think that such a party can provide progress to the nation then you are misleading the nation. On the other hand the cap wearing politicians have implemented progressive welfare schemes for the poor and constantly endeveoured to uplift the status of Muslims. There are drawbacks but these are listened to by sympathetic ears.

Your clever effort to promote the BJP/RSS in the garb of development has not fooled the Muslims. The Sangh Parivar is far more interested in implementing their communal agenda.

 

4. Now the question of voting in a herd. I don't understand what you mean by this. If Muslims do not vote for the BJP it is because of valid reasons which have been described above. It is not a sign of backwardness but a rejection of the backward ideology of the Sangh Parivar. They are voting on a very important issue. To ensure that India remains truly a secular democratic republic. You should also remember that the Indian Muslims rejected the 2 nation theory and are therefore the most loyal and patriotic citizens of this country. To insinuate that they are voting of religious ground is insulting. As far as corruption is concerned BJP is far ahead. It even corrupts minds.

So please do not teach us the ills of corruption through the medium of Islam. We know Islam better than you. Islam also teaches us brotherhood ,peace and love.First imbibe these principles in your ideology before lecturing us on corruption.

Many steps have been taken like Lokayukt,RTI and changes in law and reconstruction of institutions to uproot this evil. Prosecutions have been initiated against powerful people. People are aware of these. It is a long drawn war and the present Govt is not shying from it.

The BJP 2014 campaign is centered around corruption to hide its own diabolical objectives from the people. Your support clearly shows that you are part of this campaign and have political objectives rather than good for the Muslims.

 

5. Your last paragraph is rather interesting. You talk about fundamentalist among the Muslims but conveniently forget the fundamentalist organisation like the VHP,Bajrang Dal, RSS,Shiv Sena,BJP and host of others. If there are fundamentalist among the Muslims today it is because of the actions of these Hindu fundamentalists. What misery and agony have they not perpetuated on the Muslim community leave aside the Christians.? From Babri masjid to Godhra is a long story which would cover many pages. It is not possible to mention all of them here. The Muslim youth is angry and some of them have taken the wrong path of terrorism also. I strongly condemn resorting to violence to take revenge for the barbarities inflicted on the Muslim community. And I am echoing the voice of all Indian Muslims who are peaceful. But Mr Bhagat you claim to represent the youth of this country. How is that you speak the language of these Hindu fundamentalist and have never condemned their actions. Infact your enthusiastic support for BJP and its most perverted leader Modi makes even the devil ashamed.

So please do not give us sermons on fundamentalism. Today the Indian Muslims are model of liberalism and secularism .They represent a Ganga Jamuna Tehzeeb which the entire world appreciates. Even Pakistani leaders wish to follow this model. But you cannot clap with one hand.

 

In the end I would only state that the intellectual power and the supreme art of writing which you possess is a gift from God to you. Utilise them for some noble purpose to serve humanity in the true sense. Dont waste them to promote communal ideologies .You have miserably failed to understand the Indian Muslims and their fears and problems. Keep your dirty hands away from us.

On 16th of June,2013 at 3.30 PM Sh Sharad Yadav President of the JD(U)  announced the withdrawal of its party from the National Democratic Alliance.It took one minute for the dissolution of  a 17 years old mariage with the BJP .What happened that prompted the Chief Minister of Bihar Sh. Nitish Kumar to break this knot? Surely he was not mad or lost his senses.There was something which had deeply disturbed him and hurt him. Something which had shaken him and made him revolt and hit back.It was all over the news channel. The clever manipulation by a man named Modi to humilate and displace the elder statesman and architect of the present BJP Sh. Advani. Both Sh Vajpayee and Advani inspite of their association with the notorious RSS were aware of the plurastic nature of this nation which consists of various religion,caste,creed and languages. Experience and age have taught them that wearing communal stripes was a part of their uniform but implementation was not their creed.Advani declaring Jinnah as secular and Vajpayee lashing at Modi after the Gujrat riots were a example of this communal-secular character. But Modi changed all this. After all who is this Modi and what are his credentials that BJP has elevated him to the top leaving aside senior leaders.After all Modi name has been associated with Gujrat only.People outside Gujrat hardly connect with him.

 

Modi was a member of the RSS and started as a pracharak. He was well trained at training centres run by the RSS and was groomed for taking higher responsibilities. By 1987 he had become a dedicated Hindu fascist and was given the task of  taking the BJP ( the political wing of the RSS) to fulfill its goal of establishing a Hindu Rashtra. In 1998 he was made the National Secretary of the BJP. He was made the Chief Minister of Gujrat in 2001 after superseding senior leaders. The RSS was in a hurry to make its most loyal soldier to start the work for which he was groomed all this years. He was given the green signal sometimes in 2002. He efficiently discharged his duties. More than 2000 muslims were killed,their women raped,houses burnt. He silently implemented the RSS theory of segregating the muslims and pushing them into ghettos. The entire Sangh organisations were given a free hand to preach hatred against the minorities,to socially boycott them, and to create divisions in the minds of the people. He was highly successful in converting the entire Gujrat state into a communal factory which paid rich dividends  to him in the form of votes. He won the next 2 elections also. This was the person who was made Chairman of the election campaign committee of the BJP for elections 2014. He was further assured that he would be projected as the PM candidate of the BJP for 2014. Isnt it amazing that Modi superseded all the senior stalwarts of the BJP. The reason is clear. Others were not competent enough to accomplish what RSS wanted. To communalise the nation and work towards a facist Hindu state which is the pet project of the RSS. Just 2 days back the RSS chief Mohan Bhagwat said in Meerut :

 

"Whether somebody likes it or not, Hindutva is the only way to bring about change in the country. It is where the country's respect lies.""We have changed leaders and agendas, nothing has worked. Politics is not the way to make India a superpower, it is only Hindutva that can do it,"

 

The entire  planning to turn India into a fanatical and intolerant state has been hatched meticulously at the RSS head quarters. Earlier small scale schemes of butchering Muslims,Christians & other minorities in various of states of India like  Orissa,UP,Maharashtra etc were highly successful. This time the scheme was more ambitious.It would cover the entire country. This required a clever camaflogue to hide the real intentions and make Modi look popular among the masses. The RSS thought of a brilliant idea. The BJP would project Modi as the messiah of the masses. He will be projected as having extraordinary powers of development,organising skills,ecnomic acumen and so on and so on. Infact he was made  a superman and was projected on the screen to deceive the people of this country.Thousands of Sangh karyakartas, sister organisations , BJP workers were put into service to orchestrate that a new Messiah Modi has been born. Even thousands of fake identities were created on social media sites who constantly abused and  bullied those who did not agree with this idea. A grand illusion of the shining Modi riding on a horse galloping down to save the people in distress was projected. The real agenda of  Modi that is to replace the tricolour with the RSS bhagwa was effectively hidden behind this false front.

 

In all this grand planning the RSS forgot one thing. Something very basic and fundamental ingrained in the very nature of  we the people of India. We violently reject anything which is against humanity and smells of fundamentalism and bigotry. That  which divides and kills people in the name of religion is poison for us. It is adharam for us. In the coming days as 2014 election comes closer Modi will be exposed. Maybe from people within BJP itself who will see the destruction of this nation under this new Hitler planted amidst them. This election would decide perhaps for ever which path the nation wants to take. Communal ,divisive politics or secular and plurastic  politics. A surprise is waiting for these communal elements. It would scatter the brains of this communal monster and hopefully kill it forever.

KASHMIR SOLUTION

A recent book by a Australian Christopher Snedden titled 'Kashmir :The Unwritten History' is a attempt to distort the events in Kashmir in 1947. He has rejected the historical invasion of  the Kashmir valley by the Pashtuns aided and abetted by Pakistan in 1947. Instead  he  contends that the cause of Kashmir division was the result of rebellion by the muslims in Poonch area against the Maharaja.

I do not think we should give so much importance to a so called foreign Kashmir specialist Mr Christopher Snedden whose facts and figures seems to be dubious and at variance from established historical facts. It is a favourite hobby of foreigners to meddle into Indian affairs and history so as to create obstacles for the Indian state to function peacefully. The fact that Jinnah instructed a Pakistani General to lead the Pashtun tribals is well known. The rape and loot of the Kashmiris by the tribals is also well known. This armed attack by Pakistan in the garb of a tribal raid prompted Maharaja Hari Singh to accede to India. Till then a part of the Kashmir now known as POK was taken over by Pakistan.

Kashmir is now a integral part of India and no negotiation is possible in its status. The fact is even for plebiscite Pakistan will have to return to us the illegal occupied Kashmir to us first. Regarding the hearts and minds of the Kashmiri people, too much is made of their resentment against India. The fact is that Kashmiri people want peace and prosperity more than independence. Everybody wants it. The people of the valley know that democracy and a liberal plural society is much more better than a Jihadi society such as which exist in Pakistan. They have already rejected this option of merging with Pakistan. They can also not exist as a independent state since it would come under Jihadi attack and conspiracies from Pakistan. The Kashmiri culture is close to a secular mindset. To think that Kashmiris have turned into terrorism mode due to one instance of Afzal Guru execution is not prudent.

Regarding the option put forward by the so called foreign specialist Mr Snedden of having a Panchyat sort discussion by all the regions of Kashmir seems to me a day dreaming exercise. This can never happen specially when Pakistan has practically annexed POK and the Hindus and Buddhist would never agree to such a proposal. To my mind the best solution is to remove section 370 giving special status to Kashmir so as to merge it fully into India. Let Pakistan keep POK. After this special protocols and treaties should be signed between India and Pakistan for opening the borders in Kashmir so that the people can move freely as if it is one state.

RAGING PAKISTAN

Recently a Pew research revealed that Indians are the second most hated after the Americans. This is rather surprising. I have never understood the reasons for this dislike of Indians by the Pakistanis. Infact if history is any evidence then Indians have many reasons to hate Pakistan. After all a portion of their beloved India has been taken away and that too in the name of religion. Pakistan got all what it wanted. A separate Islamic nation. They make their own laws and have their own constitution. They are now free from the fear of Hindu domination which would destroy their culture which according to them is the Arab culture. Everything is fine. Then why the hatred against India? There is also nothing worthwhile in Pakistan for India to think of attacking it. With the partition of India under the able leadership of Jinnah every thing has been precisely cut and divided. It set me thinking and following points emerged in my mind.My Pakistani friends may hammer me on these points.

1. Let us start with Jinnah. Before 1936 he was secular. Proclaiming Hindu Muslim unity. After his Muslim league was defeated he became communal. Again his 11th August 1947 speech indicates that he became secular. He appointed a Hindu as his Law Minister. The point is that Jinnah himself lacked any commitment to any ideology. His ideology was  getting power and religion was  only a tool to be used. He himself was not a committed Muslim. His dress habits,his eating  habits,his way of life did not reflect the Mullah type of personality. He even married a non-muslim. On all accounts he can be described as a secular person.

2. Jinnah demand for a nation on the basis of Islam was the greatest fraud ever committed on the gullible common Muslims. It did not stem from any revolutionary zeal for protecting the Muslims but from the selfish reason of gaining power. The prospects of power and money in a new nation was a temptation difficult to resist. He was enthusiastically supported by the greedy intentions of the feudal elements and the landlords. He also never calculated that migration of population would take place and a carnage would follow. These eventualities never entered his mind. This was because he was not a statesman and neither a thinker. The recent book 'Between the lines' by Kuldip Nayyar describes how Jinnah wailed 'What have I done' when he saw millions of people trudging to the opposite side of the borders.

3. The partition of India was thus a event which was illogical. It was like a building being built without a foundation. There was absolutely no genuine logical reasons to support it. The Islamic card was played for gaining power.

4. To hide one dishonest action one has to go through many dishonest actions to defend it. So the endless Islamic rigidity was thrust on the people of Pakistan by Bhutto to Zia to show that the declared objectives for creation of Pakistan were indeed being implemented. Though in this enthusiasm sections of muslims apart from minorities are being targetted.

5. The people of Pakistan inherently belongs to the same secular stock to which their Indian brethren come from . They have inherited the thousands of years of culture and civilization of plurality. It is in their genes. It was therefore necessary to sow the seeds of hatred against India through their educational system. Text books and Madrassas. Poor Pakistanis have been again duped by the rulers. Till they hate India the rich can do their work in accumulating wealth. The military can enjoy the privileges.

 6. The entire story of Pakistan is a story of fraud and deception. The killings,terrorism,hatred and intolerance are the symptoms of a disease. The disease is spreading and unless truth triumphs in Pakistan there is no salvation.

7.The truth is that Pakistan and India are one people. Now since Pakistan has been formed all the good luck to it. But the fraud committed 65 years back should not be allowed to flourish now. The inflated balloon of a great Islamic state should be punctured and normal mental balance should prevail in Pakistan.

BHINDARWAJE MEMORIAL

BHINDARWALE MEMORIAL IN GOLDEN TEMPLE

FOUNDATION LAID ON 6TH JUNE,2012

The building of this memorial is the combined effort of the Akali Takht,SGPC and Akali Dal. No matter how the Akali Dal tries to distance itself from this project their consent is quite visible. It is unfortunate that a political party is actively associating itself with this project which is meant to eulogize separatist and terrorist. All political parties are sworn to uphold the constitution and by giving its silent consent the Akali Dal is  not fulfilling its constitutional obligation. They being in power should have taken steps to stop this construction.

Akal Takht and the Damdani taksal is declaring that the memorial is in the memory of Sikhs who died defending the Golden Temple from the Indian Army. This is a false and fabricated propagation. The truth is that the Army had to enter the temple to demolish Bhindarwale and his associates who wanted secession from India. The Army and the Govt of that time was taking action to protect the nation. Nobody is above the nation. Bhindarwale had declared a war on this nation and he had to be neautralised. He proved himself a coward since he holed himself into the holy shrine instead of fighting the army in the open. He was responsible for the desecration of the Golden Temple. The army infact freed it from terrorists.

The assassination of Indira Gandhi by her trusted security men came as a shock to the nation. The entire nation realised that a dirty conspiracy has been hatched to carve a Khalistan state from the Indian union. To further aggravate the situation many Sikhs and Gurdwaras started to celebrate the assassination by firing crackers and lighting candles. I personally witnessed this in my neighbourhood. This added fuel to the fire. The riots which followed was unfortunate and condemnable and should not never have occurred. But in all this unfortunate events the Bhindarwale group and sections of the Sikhs cannot absolve itself of its contribution. The celebration of Indira Gandhi assasination  was also condemnable. In the coming months large number of Hindus were killed. This was also unfortunate. All the killings were the result of madness.

The use of religion for gaining political power or for amassing wealth is a most deplorable act. Unfortunately our entire history is replete by such examples. Islam has been used to kill, Hindu fanatics are using it and the Sikhs are now doing it. The Golden temple is being used to fan the religious sentiments of the people. The aim is to alienate the Sikhs and to encourage them to form Khalistan. The claim that the Blue star memorial is for the martyred Sikhs is a shield behind which a conspiracy is being hatched to divide the country.

The people behind the building of this memorial should not forget that Sikhs are spread all over India and treated with respect. They are doing business and commercial activity without any discrimination and flourishing all over the country. They are enjoying benefits and  the nation's wealth much above their proportionate share of population. In every city and on prime lands they have been allowed to build Gurdawaras. Nobody grudges this. Everybody likes them. But they should remember that this goodwill of this nation towards them can vanish instantly if they indulge in antinational activities. The building of this Bhindarwale memorial certainly comes under this category. It will be a centre of antinational elements and under their supervision can expand. Certainly the Khalistan group with the help of the Pakistanis would do the utmost to divide the people of this country through this memorial. This is a seed which can grow into a destructive demon which will have the potential to shed blood. The backlash can be terrible and the Sikh community will consequently suffer.

I therefore fervently appeal to the Sikh community to consider all the pros and cons of building this memorial. It would be better that this is demolished at the earliest. The Akali Dal should realise that they are playing with fire by encouraging this antinational memorial. After all there is no sense in spoiling the peace and harmony which is prevailing. This should continue otherwise our children will be the worst sufferers.

THE MUSLIM NOOSE BOARD

The vast majority of Indian muslims are secular and agree with the secular and multiculture ethos which has the legal sanction of our constitution. They mingle easily with their fellow Indians who belong to various religious groups. It is no wonder that the Indian muslims have hardly been influenced by the wave of extremism and intolerance being practiced in our neighbouring country Pakistan as well as in many other parts of the world. Whatever little terrorism we have witnessed in our country by the muslims are organised and perpetuated from outside. They practice their religion peacefully and conduct their daily activities with dignity. Their attitude towards the majority Hindu community has never been unfriendly. Being in minority it is natural that sometimes unknown fears strike their hearts. Particularly when the Hindu extremist and their political bosses like the RSS and BJP make anti muslim noises and come out with strange facts and figures to convince that Hinduism is in danger. This is a tool which these right wing parties have used since many decades to snatch political power. But fortunately the DNA of the Hindus contain liberalism and multireligous philosophy and can never be moulded into instrument of hate. There is no such thing like a Jihadi Hindu and never will be. They have been trying to make Jihadi Hindus but failed barring a sprinkling which attract a lot of publicity. The point I am trying to make is that there is such a thing like Indian culture which is unique and encompasses all the varied communities of our nation. This culture endeavors to cultivate love and respect between the different communities. After all this is what all religious leaders and founders have aimed for.

Many leaders and thinkers from all religious groups in India have time to time tried to strengthened this culture to further enhance the cohesion between communities. One of the ways was to have certain laws which would be common to all religious groups. Laws which would protect the weaker sections of the society and to ensure that  medieval practices and medieval religious tenets do not become instruments of injustice. I don't think there is anything wrong in it. Unfortunately certain muslim organisations have always blocked any such common laws which would protect the weak in their society or would ban any medieval practices which have the potential to harm the individual. The main organisation is the the All India Muslim Personal Law Board or AIMPLB. They have always quoted Shariat as if it is  something written in stone. Many interpretations are made of the Shariat laws and there is nothing to prove that it is the last word. It is a guide for the conduct of day to day life of a muslim. The beauty of it is that can be used and interpret in a way which can root out any injustice or bad practice which may have crept in during the passing of centuries. However unfortunately the AIMPLB has all these years have taken a negative attitude and have been adamant not to use it as tool of social reform. Unfortunately some of the Muslim elite have merrily supported this attitude.

Recently the two important issues have been blocked by the AIMPLB. One is the compulsory registration of marriages. The other is marriages of minor girls.Islam is the only religion which allows four marriages. On top of it the nikah can be dissolved any time by the man by reciting Talaq 3 times. Can this be called justifiable and  allowed to continue, for unscrupulous elements to exploit women. Are the muslims living in some stone age? The muslims are citizens of this country and it is the duty of the state to stop such evil practice which degrade women and snatch their dignity. Registration of marriages will go a long way to protect women and empower them to protect their rights and save them from exploitation. Under no circumstanceous it can be termed as interference in religious rights. Such a law in no way makes a muslim a non-muslim. It will be applicable to all citizens and therefore cannot be termed as discriminatory. So what is the objection? AIMPLB does not agree because it says that it would erode the unique culture of muslim! What amazes me is how dumb can people get to be. But the larger question is of multiculturalism and blocking of synthesis of our population into a homogenous  unit.

The other issue is the court verdict of allowing marriages of 15 yrs old girls. This has been widely applauded by AIMPLB and certain educated class of the muslim community. The prominent among them is Sadia Dehlvi who has written a book on Sufism. Sufism is supposed to be the refined form of Islam which the Hindus also revere since it reflects the Hindu philosophy of Sarva Dharma. Sadia Dehlvi is a advocate of Sufism but does not want any reform for Muslim women. This is the hollowness of a Muslim intellectual. Nobody today would justify the marriage of minors. Instead of educating them and making them financial independent AIMPLB wants to marry them off. They are not event mentally mature to take responsibilies. In this case the minority act which prohibits marriage of girl below 18 years is not applicable to muslims. The reason given by AIMPLB is the same that it would violate their religion and diminish their distinct cultural identity. Can there be anything more rubbish than this?

It is time that the majority of the muslims raise their voices against these organisations which are working overtime to keep their community inside a dark veil. Far away from sunshine. AIMPLB and intellectuals like Sadia Dehlvi are doing their best to prevent the integration of the muslim society in the mainstream of the Indian society. They are a great disservice to this nation by keeping it fragmented. Certain common laws for all citizens are necessary to further enhance the unity of our people and show to the world that we are one. By blocking implementation of such laws which benefit all citizens they are sending wrong signals. Signals which give rise to enmity instead of brotherhood.
